General Terms & Conditions – Why-Not Shop

2. Applicability
These general terms and conditions apply to all orders, reservations, sales and transactions made through the Why-Not webshop and website.
By placing an order or reservation, the customer automatically agrees to these terms and conditions.
3. Membership & Private Club Concept
By placing a reservation or purchase through Why-Not, the customer automatically agrees to the atmosphere rules, membership structure and private club philosophy connected to the event concept.
Each booking is considered:
- a participation request
- a temporary membership within the private event concept
- and a pre-order/reservation within a private members environment.
4. Right of Refusal
Why-Not reserves the right to refuse or cancel any reservation or participation request if it does not correspond with:
- the atmosphere of the event
- private club conditions
- safety reasons
- previous incidents
- dress code requirements
- or the general philosophy of the organization.
In such cases, reservations may be refused or cancelled.
5. Private Nature of the Events
Events organized under the Why-Not brand operate within a private event concept and are not considered public events.
The organization therefore reserves the right to:
- select participants
- limit access
- modify conditions
- or refuse participation when necessary to preserve the atmosphere, safety and discretion of the concept.
6. Products & Services
Why-Not may offer:
- event tickets
- VIP formulas
- accessories
- clothing
- decoration
- lifestyle products
- sensory products
- and related items.
All products and services are subject to availability.
7. Prices
All prices are expressed in Euro (€) and include VAT unless stated otherwise.
Why-Not reserves the right to modify prices at any time.
8. Payment
Payments are processed through the payment methods offered on the website.
An order becomes final only after full payment has been received.
9. Delivery
Why-Not aims to provide correct and timely delivery of all products.
Delivery times are indicative and may depend on:
- availability
- transport
- force majeure
- or organizational circumstances.
Why-Not cannot be held responsible for delays beyond its control.
10. Tickets & Events
Purchased tickets are personal and non-refundable unless legally required otherwise.
Why-Not reserves the right to:
- reschedule events
- modify programs
- refuse access
- or cancel events in cases of force majeure or safety concerns.
11. Dress Code & Access
Events organized under the Why-Not brand require compliance with the dress code mentioned on the invitation or website.
If a visitor does not comply with:
- dress code
- safety regulations
- etiquette
- or atmosphere guidelines
the organization reserves the right to refuse access without refund.
12. Age Restrictions
Participants attending Why-Not events must be at least 18 years old.
The organization reserves the right to request proof of identity at any time.
13. Intellectual Property
All:
- visuals
- logos
- names
- texts
- designs
- atmosphere concepts
- branding
- and creative content
remain the exclusive property of Qualibre BV and may not be copied, reproduced or used without written permission.
14. Privacy & Discretion
Why-Not respects the privacy of its customers and visitors.
Personal data is only used for:
- reservations
- communication
- customer management
- and event organization purposes.
Official atmosphere photographs may be taken during events by the castle photographer.
15. Hotels & External Locations
Why-Not and Qualibre BV are only responsible for the organization of the event itself.
Any stays, incidents, behavior or situations occurring:
- inside hotels
- during hotel stays
- on hotel parking areas
- or outside the event domain
remain entirely under the responsibility of the guests and/or the hotel involved.
Why-Not and Qualibre BV cannot be held liable for such situations.
16. Liability
Visitors participate in events at their own responsibility.
Why-Not and Qualibre BV cannot be held liable for:
- loss
- theft
- damages
- injuries
- or incidents outside their direct control.
17. Force Majeure
In cases of force majeure, Why-Not reserves the right to:
- cancel events
- modify dates
- move reservations
- or temporarily suspend services.
18. Applicable Law
All agreements are governed exclusively by Belgian law.
Any disputes fall under the jurisdiction of the Belgian courts.
