Applicability<\/h2>\n<p>These general terms and conditions apply to all orders, reservations, sales and transactions made through the Why-Not webshop and website.<\/p>\n<p>By placing an order or reservation, the customer automatically agrees to these terms and conditions.<\/p>\n<hr \/>\n<h2>3. Membership &amp; Private Club Concept<\/h2>\n<p>By placing a reservation or purchase through Why-Not, the customer automatically agrees to the atmosphere rules, membership structure and private club philosophy connected to the event concept.<\/p>\n<p>Each booking is considered:<\/p>\n<ul>\n<li>a participation request<\/li>\n<li>a temporary membership within the private event concept<\/li>\n<li>and a pre-order\/reservation within a private members environment.<\/li>\n<\/ul>\n<hr \/>\n<h2>4. Right of Refusal<\/h2>\n<p>Why-Not reserves the right to refuse or cancel any reservation or participation request if it does not correspond with:<\/p>\n<ul>\n<li>the atmosphere of the event<\/li>\n<li>private club conditions<\/li>\n<li>safety reasons<\/li>\n<li>previous incidents<\/li>\n<li>dress code requirements<\/li>\n<li>or the general philosophy of the organization.<\/li>\n<\/ul>\n<p>In such cases, reservations may be refused or cancelled.<\/p>\n<hr \/>\n<h2>5. Private Nature of the Events<\/h2>\n<p>Events organized under the Why-Not brand operate within a private event concept and are not considered public events.<\/p>\n<p>The organization therefore reserves the right to:<\/p>\n<ul>\n<li>select participants<\/li>\n<li>limit access<\/li>\n<li>modify conditions<\/li>\n<li>or refuse participation when necessary to preserve the atmosphere, safety and discretion of the concept.<\/li>\n<\/ul>\n<hr \/>\n<h2>6. Products &amp; Services<\/h2>\n<p>Why-Not may offer:<\/p>\n<ul>\n<li>event tickets<\/li>\n<li>VIP formulas<\/li>\n<li>accessories<\/li>\n<li>clothing<\/li>\n<li>decoration<\/li>\n<li>lifestyle products<\/li>\n<li>sensory products<\/li>\n<li>and related items.<\/li>\n<\/ul>\n<p>All products and services are subject to availability.<\/p>\n<hr \/>\n<h2>7. Prices<\/h2>\n<p>All prices are expressed in Euro (\u20ac) and include VAT unless stated otherwise.<\/p>\n<p>Why-Not reserves the right to modify prices at any time.<\/p>\n<hr \/>\n<h2>8. Payment<\/h2>\n<p>Payments are processed through the payment methods offered on the website.<\/p>\n<p>An order becomes final only after full payment has been received.<\/p>\n<hr \/>\n<h2>9. Delivery<\/h2>\n<p>Why-Not aims to provide correct and timely delivery of all products.<\/p>\n<p>Delivery times are indicative and may depend on:<\/p>\n<ul>\n<li>availability<\/li>\n<li>transport<\/li>\n<li>force majeure<\/li>\n<li>or organizational circumstances.<\/li>\n<\/ul>\n<p>Why-Not cannot be held responsible for delays beyond its control.<\/p>\n<hr \/>\n<h2>10. Tickets &amp; Events<\/h2>\n<p>Purchased tickets are personal and non-refundable unless legally required otherwise.<\/p>\n<p>Why-Not reserves the right to:<\/p>\n<ul>\n<li>reschedule events<\/li>\n<li>modify programs<\/li>\n<li>refuse access<\/li>\n<li>or cancel events in cases of force majeure or safety concerns.<\/li>\n<\/ul>\n<hr \/>\n<h2>11. Dress Code &amp; Access<\/h2>\n<p>Events organized under the Why-Not brand require compliance with the dress code mentioned on the invitation or website.<\/p>\n<p>If a visitor does not comply with:<\/p>\n<ul>\n<li>dress code<\/li>\n<li>safety regulations<\/li>\n<li>etiquette<\/li>\n<li>or atmosphere guidelines<\/li>\n<\/ul>\n<p>the organization reserves the right to refuse access without refund.<\/p>\n<hr \/>\n<h2>12. Age Restrictions<\/h2>\n<p>Participants attending Why-Not events must be at least 18 years old.<\/p>\n<p>The organization reserves the right to request proof of identity at any time.<\/p>\n<hr \/>\n<h2>13. Intellectual Property<\/h2>\n<p>All:<\/p>\n<ul>\n<li>visuals<\/li>\n<li>logos<\/li>\n<li>names<\/li>\n<li>texts<\/li>\n<li>designs<\/li>\n<li>atmosphere concepts<\/li>\n<li>branding<\/li>\n<li>and creative content<\/li>\n<\/ul>\n<p>remain the exclusive property of Qualibre BV and may not be copied, reproduced or used without written permission.<\/p>\n<hr \/>\n<h2>14. Privacy &amp; Discretion<\/h2>\n<p>Why-Not respects the privacy of its customers and visitors.<\/p>\n<p>Personal data is only used for:<\/p>\n<ul>\n<li>reservations<\/li>\n<li>communication<\/li>\n<li>customer management<\/li>\n<li>and event organization purposes.<\/li>\n<\/ul>\n<p>Official atmosphere photographs may be taken during events by the castle photographer.<\/p>\n<hr \/>\n<h2>15. Hotels &amp; External Locations<\/h2>\n<p>Why-Not and Qualibre BV are only responsible for the organization of the event itself.<\/p>\n<p>Any stays, incidents, behavior or situations occurring:<\/p>\n<ul>\n<li>inside hotels<\/li>\n<li>during hotel stays<\/li>\n<li>on hotel parking areas<\/li>\n<li>or outside the event domain<\/li>\n<\/ul>\n<p>remain entirely under the responsibility of the guests and\/or the hotel involved.<\/p>\n<p>Why-Not and Qualibre BV cannot be held liable for such situations.<\/p>\n<hr \/>\n<h2>16. Liability<\/h2>\n<p>Visitors participate in events at their own responsibility.<\/p>\n<p>Why-Not and Qualibre BV cannot be held liable for:<\/p>\n<ul>\n<li>loss<\/li>\n<li>theft<\/li>\n<li>damages<\/li>\n<li>injuries<\/li>\n<li>or incidents outside their direct control.<\/li>\n<\/ul>\n<hr \/>\n<h2>17. Force Majeure<\/h2>\n<p>In cases of force majeure, Why-Not reserves the right to:<\/p>\n<ul>\n<li>cancel events<\/li>\n<li>modify dates<\/li>\n<li>move reservations<\/li>\n<li>or temporarily suspend services.<\/li>\n<\/ul>\n<hr \/>\n<h2>18. Applicable Law<\/h2>\n<p>All agreements are governed exclusively by Belgian law.<\/p>\n<p>Any disputes fall under the jurisdiction of the Belgian courts.<\/p>\n<hr \/>\n<h2>19.
